1. Introduction
The Kilimani Project Foundation “The Foundation” is a community membership foundation. When you join The Foundation as a "member", you are subscribing to a neighbourhood community foundation. The word "member" or "membership" refers to your subscription or your status as a subscriber to Kilimani Project Foundation membership.
These terms and conditions form the basis of the contract with the Kilimani Project Foundation. On subscribing you agree to these terms and conditions and you are providing us with the appropriate consent to handle your personal information in accordance with the laws of Kenya.
2. Data protection and use of personal data
The Foundation is the Data Controller and Data Processor of any personal data you supply. The personal data you supply will be used to process your application for membership, application for services, newsletter or information subscription or your application to join a committee.
The data collected by The Foundation will be used for: marketing; statistical and analytical purposes; to improve its own web content; to develop new products and services and to administer membership.
3. Data disclosures to third parties
The Foundation is committed to protecting privacy and personal data of its members and subscribers. The Foundation does not provide member or subscriber data to external parties except for information that is readily available in the public domain.
The Foundation may only disclose member personal data if required to do so by law or if The Foundation believes that such action is necessary: to comply with legal requirements; or to act under circumstances to protect the safety or security of its members.
4. Member opt out
Membership communication may be in the form of email, text, telephone or by post.

5. Conditions of membership - Right to refuse applications Once a member submits an application, it is reviewed by The Foundation team. Applicants who are not approved will be contacted by The Foundation individually: either with a request for further information or informing the applicant of The Foundation’s decision to decline the application.
If a member is accepted into The Kilimani Project Foundation Portal membership and subsequently it turns out that any or all of the information they provided was misleading or false: The Foundation reserves its right to revoke the membership with immediate effect, without the right of appeal.
6. Conditions of membership - Membership period
Membership subscriptions are paid and valid for a period of one year commencing on the date of payment.
7. Conditions of membership - Individual members' obligations
The Foundation expects of its members the highest standards of dignity, fairness and integrity. These values and expectations form the basis of the Kilimani Project Foundation Portal Code of Conduct that members are requested to abide by.
9. Code of Conduct
This code of conduct outlines our expectations for participants within the Kilimani Project Foundation community, as well as steps to reporting unacceptable behaviour. We are committed to providing an active and inspiring community for all and expect our code of conduct to be honoured. Anyone who violates this code of conduct may be banned from the community.
When members join, they make the following commitment to one another:
- To deal honestly and fairly in business with fellow members, employees, competitors, parents, partner organisations and the public
- To comply with the data protection standards in this Policy
- Members will respect intellectual property rights and will conduct the transfer of technology and know-how in a manner that protects intellectual property rights.
- Members will commit to protecting the reasonable privacy expectations of personal information of other members.
- Members will avoid abusive behaviour directed towards other members. Repeated and unwanted contact constitutes a form of harassment. Members should not make threats against others or advocate violence, including self-harm.
- Members agree to not post content that infringes any intellectual property or personal right of another party. Writing taken from another source should be properly attributed and block quoted.

10. Events
Members may be invited to events organised by the Kilimani Project Foundation or by its partners if such events are considered to be of value and benefit to members. Our events may be subject to separate terms and conditions. Please check these at the time of booking.
11. Governing law and jurisdiction
These terms and conditions are governed by the law of Kenya.
12. Liability
The Foundation’s liability to its members will not extend to any membership related benefits, goods or services provided by us or an external provider. This specifically excludes liability for any loss or damage suffered by a member as a result of her/his involvement in whatever manner with an external provider.
13. Force Majeure
Neither party shall be liable to the other for any delay or non-performance of its obligations by reason of matters beyond its control including, but not limited to, any act of terrorism, war, riot, civil commotion, compliance with any law or government order, fire, flood or storm, strikes, or any other industrial dispute, delay in transit, power failure, postal delay, or any event that cannot be reasonably be planned for or avoided.
These Terms and Conditions do not and shall not affect your statutory rights as a consumer.
14. Variations to this agreement
The Foundation may change these terms and conditions at any time upon giving its members 14 days prior notice. The most recent edition of these terms and conditions will be binding upon Kilimani Project Foundation members, subscribers, and users. Kilimani Project Foundation members may exit the contract if they do not accept any proposed variation.
If The Foundation privacy policies change, we will notify the members and subscribers by e-mail or a special announcement placed on this website.
